COPENHAGEN, Denmark: 3Shape recently confirmed that it has filed a patent infringement complaint against Medit, a South Korean company that specialises in CAD/CAM solutions for dental clinics and laboratories. The complaint was filed in the District Court for the Western District of Texas in the US and relates to a range of Medit’s intra-oral scanning products.
In its complaint, 3Shape asserts that a number of its patents related to wireless scanning, scanning software and colour shade measurements are infringed upon by Medit’s i500, i600, i700 and i700 wireless intra-oral scanning systems. The Danish company is seeking an injunction against Medit as well as monetary damages.
“The innovation and scanner technology in 3Shape TRIOS are unique and fundamental to why we are the choice of doctors,” Thomas Kirkbak, director of litigation and compliance at 3Shape, said in a press release. “TRIOS has received the Best of Class award for intra-oral scanners an unprecedented ten years in a row. We simply cannot allow other companies to copy our hard-earned technology and infringe on our patent.”
3Shape continues its legal battles
In 2019, 3Shape filed a similar patent infringement suit against Medit in the Higher Regional Court of Düsseldorf in Germany. On 9 January of the following year, the court ruled that the Medit i500 intra-oral scanner violates 3Shape’s European patent no. 2568870B1 regarding its hole-closing technology. This decision meant that the marketing, sale and commercial use of that version of the Medit i500 were thus rendered illegal in Germany.
In addition to these cases, a four-year legal dispute between 3Shape and Align Technology relating to patents and business practices concerning the companies’ intra-oral scanning solutions was brought to an end earlier this year when a confidential settlement was reached. Both companies had lodged petitions to invalidate certain patents issued to the other and noted that they were pleased that the matter had been resolved.
